Abstract:传统行政法理论认为，行政规则是行政机关制定、适用于内部管理的行政规范，因为其不对外部行政相对人适用，所以不会侵犯相对人的权益。事实上，行政规则在适用过程中常常会越过边界对外部相对人产生侵益性的效果，这种现象称为行政规则效力的外部化。行政规则具有多种类别，不同种类的行政规则，其效力外部化的表现形式并不相同。对行政规则的适用应该借助行政诉讼进行审查，并对其效力外部化的效果给予相应的救济。
